These Terms apply to all services provided by EduRights.
EduRights is the trading name of Priscilla Moothien, a sole trader. The service provides independent advocacy and consultancy support in relation to Special Educational Needs and Disability (SEND), Education, Health and Care Plans (EHCPs), and related education processes.
EduRights is not a firm of solicitors and is not regulated by the Solicitors Regulation Authority. The services provided are advocacy and consultancy support and do not constitute a regulated legal service provided by a practising solicitor.
Services may include (but are not limited to):
The exact scope of work for each matter will be confirmed in writing before substantive work begins. Advice is given in good faith on the basis of the information and documents supplied by the client. No guarantee is given that any particular outcome will be achieved. Final decisions rest with the relevant local authority or Tribunal.
3.1 A free initial 20-minute consultation may be offered. This does not create a binding contract for further work.
3.2 Formal engagement begins when the client confirms they wish to proceed and accepts these Terms, and any agreed fee or deposit has been received where required.
3.3 EduRights reserves the right to decline instructions where there is a conflict of interest, insufficient information, or where the matter falls outside the scope of the service.
4.1 Fees may be charged on a fixed-fee, hourly, or staged basis. The basis of charging will be confirmed in writing before work begins.
4.2 Where a fixed fee is agreed, it covers the specific scope of work described. Additional work will be charged separately and agreed in advance where reasonably possible.
4.3 Invoices are payable within 14 days of the invoice date unless otherwise agreed in writing.
4.4 Payment should be made by bank transfer to the account details provided on the invoice.
4.5 EduRights reserves the right to suspend further work if invoices remain unpaid beyond the due date.
4.6 All fees are currently quoted exclusive of VAT. If EduRights becomes VAT-registered in the future, VAT will be added and clients notified.
5.1 The client may cancel the free initial consultation at any time without charge.
5.2 Once formal engagement has begun, the client may terminate instructions at any time by written notice. The client remains liable for fees for work properly carried out up to the date of termination.
5.3 Where a fixed-fee package has been paid in advance and the client cancels before the majority of the work has been completed, a fair proportion of the fee may be refunded.
5.4 EduRights may terminate the engagement if the client fails to provide necessary information, fails to pay invoices when due, or if a conflict of interest arises.
5.5 Consumer cancellation rights under the Consumer Contracts Regulations 2013 may apply to distance contracts.
The client agrees to provide accurate, complete and timely information and documents, notify EduRights of any material change in circumstances, and respond to reasonable requests for information within agreed timescales.
7.1 Consumer Statutory Rights
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under the Consumer Rights Act 2015 or applicable English law.
7.2 Scope of Service
The client acknowledges that EduRights provides independent advocacy and consultancy support, not a regulated solicitor service; advice is given in good faith based on the information supplied; no guarantee is given of any particular outcome; and final statutory decisions rest with the relevant local authority or Tribunal.
7.3 Financial Cap on Liability
Subject to clause 7.1, the total liability of EduRights to the client for any claim shall be limited to the total fees paid by the client in the 12 months immediately preceding the event giving rise to the claim.
7.4 Exclusion of Indirect Loss
Subject to clause 7.1, EduRights shall not be liable for any indirect or consequential loss, including loss of opportunity, loss of future earnings or emotional distress.
EduRights will keep client information confidential except where disclosure is required by law or is necessary for the proper performance of the services. Personal data is handled in accordance with the Privacy Notice.
If you are dissatisfied with the service, please contact Priscilla Moothien at hello@edurights.co.uk. EduRights will aim to respond fully within 14 days. As an unregulated consultancy there is no external legal ombudsman scheme, but this does not affect your statutory rights as a consumer.
10.1 These Terms are governed by the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
10.2 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
10.3 These Terms constitute the entire agreement between the parties in relation to the services.
